To begin with, child support payments can begin before the parenting agreement is finalized. As soon as the parents separate or one parent moves out of the house, a parent can file for temporary child support. This support payment is based on the same formula that is used for the permanent support. Every state uses different factors, but almost every state uses the timeshare percentage to calculate the amount that needs to be paid. This means that the parent who has the most time with the children receives the support. The amount of support is based on the time difference and the other factors the state includes.
The family court wants to see an arrangement that represents the best interests of the children. Ideally, both parents will work together to be involved in their children`s lives and will set up a reasonable arrangement that does not disrupt their environment too much.
Making an effective parenting plan is not always easy. It can be overwhelming and scary at times trying to figure out what to include to make it the best it can be. Parents may not know what needs to go into a plan to make effective and worthwhile. Let`s take a look at what a basic plan entails so you know what you should include: A parenting time schedule that shows when each parent cares for the child; A schedule for holidays, birthdays, vacations and special events in the child`s life; Information about the child`s expenses including information about child support; A dispute resolution process that determines how parental disagreements are resolved; A process for making changes to the plan as circumstances change and the child grows older; Provisions the parents feel are necessary for providing and caring for their child; and Additional information that will help make the plan more effective.
Another key issue in making a joint custody parenting plan work is proximity to the other parent. When children have to shuffle between households frequently, it leaves them feeling unsettled, distracted and conflicted. You both can minimize those feelings by remaining in close proximity to each other and to your children`s schools and friends. When transitions between homes are smooth and conflict-free, joint custody can benefit children.
Along with the times of visitation, the parenting agreement needs to contain details of where the visitation takes place and how the kids are transported there. To help the children adjust, the parent who has moved out may come to the children`s home for visitation. This may help the children feel more at ease. If the children are older and able to handle going to the parent`s new home, they can visit there. The mother and father should work out who will pick up and drop off the children.
Divorce and separation are difficult not only for the child but also for the parents. It is important that the parents do all they can to make the transition as seamless and easy as possible. Parents should try and work together if possible to create a single parenting plan so it is created in the child`s best interests. Courts will mostly accept a plan upon which both parents agree and have cooperated on.
