If parents decide to separate and the mother or father moves out the house, the parents need to figure out the child custody situation during this time. Because the time of separation is uncertain and the parents usually do not know how it will end, the mother and father should come up with a parenting agreement for temporary custody. Temporary child custody refers to the time period when the parents are waiting to find out if or when they will need a permanent parenting agreement.
Along with the times of visitation, the parenting agreement needs to contain details of where the visitation takes place and how the kids are transported there. To help the children adjust, the parent who has moved out may come to the children`s home for visitation. This may help the children feel more at ease. If the children are older and able to handle going to the parent`s new home, they can visit there. The mother and father should work out who will pick up and drop off the children.

In this case, the non-custodial parent must file a petition within 96 hours to prove his or her case or else be charged with kidnapping. If the child has not been returned by the non custodial parent, a police report must be filed immediately. The Federal Bureau of Investigation usually assists in parental abductions since many of the involve taking children across state lines. Finally, anyone who has been granted visitation must abide by the court order. If not, he or she will face contempt charges. While jail sentences only happen in rare cases, a judge could order jail time for a parent that violates the order.
